A Point Base System (PBS) has been put into place since 2008 to crack down on bogus and false applications from foreign students. Institutions are now required to register with the UK Border Agency before they are allowed to sponsor an international student, under the PBS

Points Based System:

On Monday 30 June 2008, the Home Office fully put into practice Tier 1 of the points based system. Tier 1 (General) established the Highly Skilled Worker, industrialist, Investor and Post Study Work categories.

Tier 2 will substitute the current Work Permit from November 2008 under the point based system. We can give advice to employers how to apply for licence and assist in issuing certificates of sponsorships to potential employees.

If you are an European Economic Area (EEA) or Swiss national, you are free to enter and stay in the United Kingdom.

We can support and help you to register with the Home Office or apply for permission before you start to work and also apply for permanent residency for you and your non-EEA dependants.

UK Residency and Nationality Advice:

We can give advice on aspects of UK Residency, your rights and responsibilities; support you with making applications for naturalisation, extension of visas and indefinite leave to remain in the UK.

Justice & Law Solicitors can provide additional details of this scheme or any of the above.

Our skilled team will provide a professional and high quality service to our clients on all immigration matters.

Along with our usual rates we can offer Fixed Fees for standard applications so you know the cost at the start of your case.

If you are in the country illegally and wish to legalise your stay in the UK, then contact us today.

Landlords/Tenants

Justice and Law Solicitors offer expert legal advice for both tenants and landlords. If you rent your home or if you are a leaseholder, you have a legal agreement with your landlord or freeholder. This gives you both rights and responsibilities.

Check any agreement you have carefully and ask questions about anything you're not sure of. But be aware that you may have more rights than you thought.

There are laws that regulate how renting and leasing work in this country and if your agreement doesn't comply, it may not be legally binding.

This could make a big difference if the landlord or freeholder is being unreasonable, or wants you to leave the premises.

All landlords and tenants/licensees have certain rights and responsibilities, even if they’re not written into an agreement. Some rights and responsibilities apply to all agreements.

Others may be set out in the tenancy/ licence agreement. Others are set out in the legislation that applies to the particular type of tenancy or licence you have.

Legal Advice for Tenants.

We advise tenants on their rights and on the duties of their landlords. Your landlord is legally required to maintain your property to certain standards. If you are worried about being evicted contact us now.

Tenants benefit from a great deal of protection from being evicted. Landlords must follow a strict set of procedures set forth by law if they are to remove you from your home. There is always something we can do to either stop the eviction process or at least delay it.

Our legal experts are ready to offer tenants excellent legal advice.

You may be entitled to claim compensation from your landlord if:

  • Your landlord has failed to place your deposit in a scheme
  • Your landlord has not correctly maintained your home
  • You have suffered a personal injury at your home

We can help you stay in your home if you have received an eviction notice or a claim from the courts.

Our “Legal Advice For Tenants” department is ready to help!

Civil Litigation

Civil law, unlike criminal law, is the section of the law that deals with disputes between individuals or organizations. In these types of cases compensation may be awarded to the victim.

A Civil Action often includes the following steps unless it is settled out of court by mutual agreement:

1. Pre-commencement of proceedings.

At this stage of the process we will analyse what you are trying to achieve. We will advise you on the route we consider will lead to the most cost efficient solution for your particular circumstances. The issue of proceedings should be considered as a last resort.

2. Commencement of the action.

We will draft all the relevant papers and we will be responsible for lodging them at a County Court or High Court on your behalf.

3. Interim Matters.

Once the matter has been issued at court it is usual for a strict timetable of events to be given. This timetable has to be adhered to and we will assist you to make sure the necessary steps are taken.  We will advise you on the best approach going forward with the case.

4. Trial.

If the matter has still not been resolved the parties must then prepare for trial. We help you get ready for the trial, and we will be responsible for organising your representation at court and we will also advise you of any costs incurred as a consequence of going to trial. The general rule is the loser pays the winner's costs.

5. Post-Trial.

A party who is successful at trial will often be awarded damages and/or costs. We can help you assess the most appropriate methods available to enforce the judgement and take the necessary steps involved in resolving the matter in your favour.

Civil law courts provide a platform for deciding disputes involving torts (such as accidents, negligence, and libel), contract disputes, the probate of wills, trusts, property disputes, administrative law, commercial law, and any other private matter that involves private parties and organizations including government departments.

Civil Litigation is a way of resolving disputes or claims between individuals or companies.

In most cases, this is the process to resolve public and private legal disputes or claims on civil matters through negotiation, mediation or through the courts.

The objectives of civil law are different from other types of law. In civil law there is the attempt to right a wrong, honour an agreement, or settle a dispute. If there is a victim, they get compensation, and the person who is the cause of the wrong pays, this being a civilized form of, or legal alternative to, revenge.
